BB&D attorney Bob Blitz successfully defended an arbitration award in federal court in St. Louis. The Court entered a $1.7 million judgment for BB&D’s client, a design-build contractor, confirming an arbitration award that Blitz recently won for his client. The judgment is against a subcontractor on an estimated $1 billion industrial project for a customer that manufactures parts for the airline industry. The arbitrator found the subcontractor had breached its contract with the design-build contractor by failing to provide the labor and materials to meet the project’s schedule. After the arbitrator entered his award, the subcontractor filed a motion in federal court in St. Louis to vacate the award, arguing that nearly every aspect of the arbitration process was deficient under the law and the parties’ contract, and that the award should be vacated. After a hearing, the Court denied all of the subcontractor’s arguments and entered the full judgment in favor of BBD’s client.
