BB&D attorney Robert Blitz succeeded in defending BB&D client Kansas City-St. Louis Regional Carpenters Regional Council on appeal before the United States Eighth Circuit Court of Appeals. The District Court previously dismissed a Union member’s attempt to bring action against a union official for breach of statutory duties. The appeal involved complex issues of law under the Labor-Management Reporting and Disclosure Act (“LMRDA”) that had never been addressed by the Eighth Circuit. The Eighth Circuit agreed with BB&D’s argument that the Carpenters Council satisfied the requirements under the LMRDA and affirmed the dismissal of the lawsuit. The victory continues BB&D’s recent success in defending the Carpenters Council. In a related case brought by the same plaintiff, BB&D successfully defended the dismissal of a wrongful termination lawsuit that saw appeals taken all the way to the Missouri Supreme Court.
